Radiation Exposure Compensation Act (RECA)

The New Mexico Department of Health (NMDOH) created an informational website and FAQ for individuals and families interested in submitting a RECA application for compensation. The website and FAQ cover eligibility, application process, and provide helpful answers to many questions regarding RECA.
What is RECA? It is a federal law that gives money to people who developed certain serious illnesses after being exposed to radiation from nuclear tests in the United States. It can also help their families. The U.S. Department of Justice (DOJ) runs the RECA program.
Who is eligible for compensation? *Each category must meet certain eligibility requirements such as living in the contaminated areas during a certain period of time and contracting a compensable disease. See the list of criteria, location, dates, and diseases at https://www.justice.gov/civil/reca.
- “Downwinders” – individuals who developed certain cancers after presumed exposure to radiation released during the atmospheric nuclear tests conducted within the United States. Download application form.
- Onsite Participants – individuals who participated onsite in a test involving the atmospheric detonation of a nuclear device and later contracted a compensable disease. Download application form.
- Uranium Workers – individuals who worked in covered occupations relating to uranium mining during the period from January 1, 1942, through December 31, 1990. Download application form.
- Manhattan Project Waste – individuals who developed a covered illness after living, working, or attending school in areas affected by Manhattan Project waste contamination. Download application form.
What is the application process? Gather all necessary documentation including the following. Note: NMDOH can help with birth and death certificates.
- Proof of residence, employment, or onsite participation during a qualifying period;
- Medical records documenting your diagnosis of a compensable disease; and
- Identification documentation as described on the claim form.

What amount is the compensation?
- Qualified individuals may get a one-time payment of $100,000.
- If the person has died, their survivors can apply for equal shares of that single payment.
- Currently, according to the federal government, this money is tax-free, and do not need to report it on taxes.
- When is the application deadline? All claims must be filed by December 31, 2027.
